Terms 1. Legal information and acceptance

These regulations govern the use of the Internet portal service (hereinafter the "Website") that Guerrero Cruz Hnos SL (hereinafter, Decorhaus) makes available to its Internet users.

Access to the site is free except for the cost of the connection through the telecommunications network provided by the service provider contracted by the users. Certain services are exclusively for our customers and their access is restricted. Tax or legal services provided by the Firm in general, have the price indicated in the relevant commercial offer and are never offered or provided through the service of the portal.

The use of the Portal confers the status of Portal User (hereinafter the "User") and implies acceptance of all conditions contained in this Legal Notice. The provision of service on this Website are limited to the time when the user is connected to the Website or services that are provided through it. Therefore, the User should carefully read this Legal Note in each of the occasions on which it intends to use the websitel, since the portal and its terms of use contained in this Legal Note may change.

Some Portal services accessible to the Internet users or exclusive to Decorhaus customers may be subject to particular conditions, regulations and instructions, that if necessary, replace, supplement and / or modify this Legal Note and which must be accepted by the User before the provision of the service concerned.

2. Intellectual and industrial property

All contents of the Portal, which includes but is not limited to text, photographs, graphics, images, icons, technology, software, links and other visual or audio, graphic design and font codes (herein ' Contents ") are copyrighted by Decorhaus or third parties, without being interpreted as any rights of the user to exploit them beyond what is strictly necessary for the proper use of the Portal.

The trademarks, trade names or logos are owned by Decorhaus or third parties and the access to the Website does not confer any rights to these trademarks, trade names and / or logos.

3. Terms of use of the Portal

3.1 General

The User is obliged to use the Website properly in accordance with the Law and this Legal Note. The user will be liable to Decorhaus or third parties for any damages that may be caused by breaching this obligation.

It is expressly forbidden to use the Portal for purposes that infringe the property or interests of Decorhaus or third parties, or in any other way overload, damage or disable the networks, servers and other computer equipment (hardware) or products and applications (software) of Decorhaus or third parties.




3.2 Contents

The User agrees to use the Content in accordance with the Law and this Legal Note, as well as other conditions, regulations and instructions that could be applied in accordance with the provisions of Clause 1.

Including but not limited to, the User in accordance with applicable law must not:

Reproduce, copy, distribute, make available, publicly communicate, transform or modify the Content, except for those cases permitted by law or if expressly allowed by Decorhaus or whoever holds the title of the exploitation rights in this case.

Reproducing or copying for private use any Content that may be treated as software or a database in accordance with current legislation on intellectual property, as well as publicly communicating or making available to third parties when those acts necessarily involve the reproduction by the User or any third party.

Extract and / or reuse all or a substantial part of the Content of the website or of the databases that Decorhaus makes available to the users.

3.3 Data Collection Forms

Without affecting Clause 5 of this Legal Note, the use of certain services or requests to Decorhaus are conditioned by the completion of the corresponding user registration.

All information provided by the user through the forms in the Portal for the above or any other purposes must be true. Therefore, the User guarantees the authenticity of all data provided and will maintain the information given to Decorhaus fully updated so that it responds at all times to the real situation of the user. In any case the User shall be solely responsible for any false or inaccurate statements made and the damage caused to Decorhaus or third parties by the provided information.

3.4 Introduction of links to the Portal

The Internet user who wants to introduce links from their own websites to the Portal must comply with the conditions listed below. The ignorance of the conditions does not avoid the responsibilities that derive by law:

The link will only connect to the home page or main page of the Portal but can not reproduce it in any way (inline links, copy text, graphics, etc).

It is forbidden, in accordance with the applicable and current law, to establish frames of any kind that involve the portal or permit the display of the Content over Internet addresses other than the Portal one and, however, when viewed together with content outside the portal so that it: (i) causes, or may cause confusion or misleading users about the true origin of the service or Content, (ii) involves an act of comparison or unfair imitation, (III) serves to exploit the brand reputation and prestige of Decorhaus, or (IV) in any other way prohibited by the applicable law.

The page that introduces the link cannot make any false, inaccurate or incorrect statements about Decorhaus, their partners, employees, customers or the quality of their services.

In no manner the page where the link is located will express that Decorhaus has consented the insertion of the link or in any other way sponsors, collaborates, verifies or supervises the services of the sender.

It is prohibited to use any brand name, graphics or both or any other distinctive sign of Decorhaus on the sender´s page, except for those cases permitted by law or expressly authorized by Decorhaus and when permitted then with a direct link to the Website as it is prescribed in this clause.

The page containing the link must comply with the law and may not under any circumstances provide or link to contents from them or third parties that: (i) are unlawful or contrary to morality and decency (pornographic, violent, racist, etc.), (II) induce or could induce the user to a false impression that Decorhaus endorses, supports, or joins in any way the ideas, statements or expressions, legal or illegal, made by the sender, (III) are inappropriate or irrelevant to the Decorhaus activity regarding the place, contents and theme of the sender's website.

4. Disclaimer

4.1 of the Information

The access to the Site does not imply any obligation on behalf of Decorhaus to verify the truthfulness, accuracy, suitability and completeness of the information provided by it. The contents of this page are general and do not in any way, provide tax or legal advice of any kind, so this information is insufficient for the User to make personal or business decisions.

Decorhaus will not be responsible for the decisions made based on the information provided in the Portal or damages caused to the user or third persons because of actions that are based solely on the information obtained in the Portal.

4.2 of Quality of the service

The access to the Site does not imply any obligation on behalf of Decorhaus to ensure the absence of viruses, worms or other harmful computer elements. The User, in any case, should have the adequate tools to detect and eliminate malicious software.

Decorhaus is not responsible for any damage caused to the computers of the users or third parties during the use of the service of the Portal.

4.3 of Availability of the Service

The access to the Portal requires services and supplies from third parties, including the transmission through telecommunications networks, whose reliability, quality, continuity and operation does not correspond to Decorhaus. Accordingly, the services provided through the Website may be suspended, canceled or be inaccessible, prior or simultaneous to using the service of the Portal.

Decorhaus will not be liable for any damages of any type caused to the User as a result of failure or disconnection of telecommunications networks that produce the suspension, cancellation or interruption prior or during the use of the Portal service.


4.4  of content and services linked through the Portal

The access to the Portal includes technical links, directories and even search tools that allow the user to access other Internet sites and portals (hereinafter "Linked Sites"). In these cases, Decorhaus acts as a intermediary provider of services in accordance with Article 17 of Law 32/2002 from the 12th of July on Services from the Information Society and Electronic Commerce (LSSI) and will only be responsible for content and services provided in the linked sites to the extent that it is aware of the illegality and has not disabled the link with due diligence. In the event that the User considers that there is a Linked Site with unlawful or inappropriate content he may inform Decorhaus in accordance with the procedure and the purposes set out in clause 6, but in any case this communication does not entail the obligation to remove the corresponding link.

In any case, the existence of Linked Sites does not presuppose agreements with the managers or owners of these sites, or the recommendation, promotion or identification of Decorhaus with the statements, content or services provided there.

Decorhaus does not know the content and services on the Linked Sites and is therefore not responsible for damage caused by the unlawfulness, quality, unavailability, error or uselessness of the content and / or services of the Linked Sites or any other damage that is not directly attributable to Decorhaus.


5. Privacy Policy

The data collected through data collection forms from the Portal will be incorporated into an automated file of personal data which Decorhaus is responsible for. This entity will treat the information confidentially and exclusively for the purpose of managing the customer relationships and promote the activities of the company. Also, Decorhaus will cancel, delete and / or block data when it is inaccurate, incomplete or no longer necessary or relevant for their purpose, in accordance with the provisions of the legislation on data protection.

Pressing the 'send' button in the corresponding form, the user expressly consents that his data may be used for sending commercial communications by e-mail or other means.

In the data collection forms, the fields marked with an asterisk are required so that if this data is not provided, Decorhaus may at its sole discretion deny the corresponding service.

Users may revoke the consent and exercise their rights of access, rectification, cancellation and opposition to that effect contacting the address specified in clause 1 and visibly indicating the specific right that is being exercised.

Decorhaus meets the security levels required by the Regulation on Security Measures approved by the Decree 994/1999 from the 6th of June. In spite of that the technical security via the internet is not impregnable and can be leaked by willful misconduct of third parties.

Decorhaus may use cookies during the provision of the service of the Portal. Cookies are automatic collection of information on the preferences of a user whilst visiting a particular website. This information is recorded in small files that are stored in the user´s computer seamlessly. Each time the user returns to the website, these files are automatically activated so that the website is configured with the preferences indicated in previous visits. In short, cookies are physical files of personal information stored on the user's terminal and unequivocally associated with this terminal. Cookies cannot read cookie files created by other suppliers.

Users have the ability to configure their browser so as to prevent the creation of cookie files or display a warning when this occurs. The Portal is accessible without having to activate the options related to cookies, although they may prevent the proper functioning of security mechanisms for certain services that require a greater security. Generally, the purpose of the cookie file of the Portal is to facilitate the navigation of the user.

The domain name server that transmits and enables the automatic procedures of collection is SERVIDOR2.DNSPRIMARIO.COM and SERVIDOR2.DNSSECUNDARIO.COM and its validity is 12 months, after which the cookie files are automatically deleted.

6. Communication of unlawful and inappropriate activities

In the event that the User or any other Internet user becomes aware that a Linked Site refers to pages which contents or services are unlawful, harmful, degrading, violent or contrary to morality may contact Decorhaus indicating the following :

Personal data: name, address, phone number and email address;

Description of events that reveal the illegal or inappropriate nature of the Linked Site;

In the case of violation of rights, such as intellectual and industrial property, provide the personal data of the holder of the rights infringed when it is not the same person as the petitioner. It should also provide the certificate attesting the legitimacy of the rights of the holder and, when necessary, the authorization to act on behalf of the owner of the rights when it is someone else than the petitioner.

Affirmation that the information contained in the complaint is accurate.

The receipt by Decorhaus of a notification specified under this clause will not, in accordance with the LSSI law, assume the actual knowledge of the activities and / or contents specified by the informant.

7. Legislation

This Legal Notice is governed in each and every one of its clauses by the Spanish law.
